At the time of writing, BTC is hovering above $75,600, down around 3% since the CLARITY Act setback and wider crypto market selloff. Attention is now shifting to whether Bitcoin can hold this level and what the US Federal Reserve signals about interest rates.

Why did the Bitcoin price fall?

On 15 September, the Senate voted 49–50 against invoking cloture on a motion to consider the CLARITY Act. The bill needed 60 votes to advance.

The legislation would create a broader federal framework for digital assets and divide regulatory responsibilities between the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC).

Bitcoin’s classification is not the main issue. The CFTC has treated BTC as a commodity since 2015, while the SEC listed it as a digital commodity in its March 2026 interpretation. However, the CLARITY Act would place wider rules for crypto platforms and businesses into federal law.

The failed vote does not formally kill the bill, but its path through Congress is now uncertain. Senate Banking Committee Chair Tim Scott said the SEC and CFTC must set crypto rules under their existing powers until Congress passes legislation.

Where could the Bitcoin price go next?

Bitcoin’s price move towards $75,000 places the focus on its next support and resistance levels.

TradingKey analyst Alan Long said the fall below $76,000 could open the way towards $71,000, followed by $70,000 if selling continues.

On the upside, BTC Markets analyst Rachael Lucas said a return above the pre-vote opening price of $78,189 would be the first sign that traders are moving past the regulatory setback.

How could the Fed decision affect Bitcoin?

At the time of writing, Crypto.com Predict traders placed the chance of a rate increase of up to 25 basis points at around 90%. Because a quarter-point hike is widely expected, the decision itself may have a limited effect on Bitcoin. 

The Fed’s outlook could be more important. Signals of further hikes could put additional pressure on BTC, while an unexpected decision to leave rates unchanged could support crypto prices.
